Introduction

Welcome to www.storeus.com (the “Storeus Website”). These Website Terms and Conditions set out the terms on which you can access and use the Storeus Site and Mobile App and the use of any services, information and functions made available by us including our mobile application (collectively called “Storeus Services”). By registering, accessing or using our Storeus Services, you agree to be bound by these Terms and Conditions and all other terms and conditions and policies pertaining to the use of the Storeus Site and/or Storeus Services including its amendments and you consent to the processing of your personal data as described in the Privacy Policy.


The Storeus Site is operated by SIGNATURE TECHNOLOGY DMCC, a Free Zone Company duly registered with the DMCC Free Zone under license no. DMCC-633181, with its office located at Unit No: 3707, Mazaya Business Avenue BB2, Plot No: JLTE-PH2-BB2, Jumeirah Lakes Towers, Dubai, UAE including its affiliates and subsidiaries (individually and collectively, “we,” “us,” or “our”). All references to Storeus Site and Mobile Application in these Terms and Conditions shall deem to refer to the aforesaid entity in the inclusion of the online portal.


The provisions stated in these Terms and Conditions may be changed or modified by us from time to time and your continued use and access to this Storeus Site and Mobile Application constitutes your agreement to such changes.


By accessing the Storeus Site and Mobile Application, you confirm your understanding of the Terms and Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this website or should not use the mobile application. The Storeus Site and Mobile Application reserve the right to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Storeus Site and Mobile Application with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes.


General

Definitions

- “Applicable Laws” means any rules, regulations and laws of the Emirate of Dubai and United Arab Emirates.

- “Storeus Services” means the use of any services, information, details, etc. that are available on the Storeus Site and Mobile Application.

- “Goods” means any goods or services available for sale or supply on the Storeus Site and Mobile Application.

- “Seller” means any licensed entity including its employees or any other permitted users that uses, registers and access the Storeus Site and Mobile Application to sell Goods to the Buyer.

- “we,” “us,” or “our” means Signature Technology DMCC and its employees or a third-party (including contractor and agents), in addition to its affiliates.

- “you” or “your” means any person who purchases Goods from the Seller on the Storeus Site and Mobile Application.

Modifications to the Website Terms and Conditions

We may modify these Terms and Conditions at any time by posting a revised version on the Storeus Site and Mobile Application or by otherwise notifying you. By continuing to use the Storeus Services after the effective date of any modifications to these Terms and Conditions, you agree to be bound by the modified terms. It is your responsibility to check the Storeus Site and Mobile Application regularly for modifications to these Terms and Conditions.

Force Majeure

We and our affiliates will not be liable for any delay or failure to perform any obligation under thеse Terms and Conditions where the delay or failure results from any cause beyond our reasonable control, including acts of God, labor disputes or other industrial disturbances, systemic electrical, telecommunications, or other utility failures, earthquake, storms or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.

Further Assurances

The parties will do and execute or arrange for the doing and executing of each necessary act, document and thing reasonably within its power to implement and give effect to these Terms and Conditions to its full extent, including without limitation assisting each other in complying with applicable law.

No Third-Party Beneficiaries

These Terms and Conditions do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms and Conditions.

Notice

To You. We may provide any notice to you under this Terms and Conditions by: 

(i) posting a notice on the Storeus Site and Mobile Application; or 

(ii) sending a message to the email address then associated with your account. 


Notices we provide by posting on the Storeus Site and Mobile Application will be effective upon posting and notices we provide by email will be effective when we send the email. 

It is your responsibility to keep your email address current. You will be deemed to have received any email sent to the email address then associated with your account when we send the email, whether or not you actually receive the email.

(iii) by personal delivery, overnight courier or registered or certified mail to Storeus.com, Mazaya Business Avenue, building BB-2, floor 37, office 3707-08, Dubai, UAE;

Language

These Terms and Conditions shall be made in two (2) languages, Arabic and English, each of which shall be deemed an original.

No Waivers

The failure by us to enforce any provision of these Terms and Conditions will not constitute a present or future waiver of such provision nor limit our right to enforce such provision at a later time. All waivers by us must be in writing to be effective.

Severability

If any portion of these Terms and Conditions is held to be invalid or unenforceable, the remaining portions of these Terms and Conditions will remain in full force and effect. Any invalid or unenforceable portions will be interpreted to effect and intent of the original portion. If such construction is not possible, the invalid or unenforceable portion will be severed from these Terms and Conditions but the rest of the Terms and Conditions will remain in full force and effect.

Governing Law; Venue

This Website Terms and Conditions and any disputes or claims arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) are governed by, and construed in accordance with, the law of the United Arab Emirates. Both parties irrevocably agree that the courts of Dubai, UAE (excluding DIFC Court) have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or its subject matter or formation (including non-contractual disputes or claims.

Entire Agreement

These Terms and Conditions including any terms, conditions, policies and/or instructions that we may set from time to time is the entire agreement between you and us regarding the subject matter of these Terms and Conditions. These Terms and Conditions supersedes all prior or contemporaneous representations, understandings, agreements, or communications between you and us, whether written or verbal, regarding the subject matter of these Terms and Conditions.

Third Party Rights

A person who is not a party to these Terms and Conditions has no right to enforce any of its terms.

Relationship of the Parties

Nothing contained in these Terms and Conditions will be deemed or construed by the parties or any third party to create the relationship of partnership, joint venture or agency between the parties, it being understood that the parties will at all times remain independent parties contracting for Storeus Services.

Further Assurances

The parties will do and execute or arrange for the doing and executing of each necessary act, document and thing reasonably within its power to implement and give effect to these Terms and Conditions to its full extent, including, without limitation, assisting each other in complying with applicable law.

Assignment

These Terms and Conditions will be binding upon and ensure to the benefit of the parties and their respective successors and permitted assigns. You agree that you will not assign or transfer these Terms and Conditions or any of your rights or obligations under these Terms of Use, whether directly or indirectly, without first obtaining our prior written consent, such consent not to be unreasonably withheld.

Amendment

These Terms and Conditions cannot be modified, varied, amended or supplemented in any way by you. We reserve the right to modify, vary, amend or supplement these Terms and Conditions at any time and from time to time. We will post the current version of these Terms and Conditions on the Storeus Site and Mobile Application and each such change will be effective upon posting on the Storeus Site and Mobile Application or upon the date designated by us as the “effective date” (if any). Your continued use of the Storeus Services following any such change constitutes your agreement to be bound by and its acceptance of these Terms of Use as so modified.

Survival

All provisions that either expressly or by their nature survive, will survive suspension or termination of your membership of the Storeus Site and Mobile Application.


Terms of Use

Storeus Website and Mobile Application

The Storeus Site and Mobile Application operate as a marketplace designed to allow entities (the “Sellers”) to offer and sell products and services (the “Goods”) and for you to order, purchase, avail and buy said Goods. Thus, we have no control over the quality, safety, morality or legality of any aspect of the Goods listed, the truth or accuracy of the listings, the ability of Sellers to sell items or your ability to pay for the Goods ordered.


We do not check or validate the content or information provided by users and sellers and cannot ensure that you or the Seller will actually complete a transaction.


We reserve our right to amend, modify, add, remove or suspend all or any portion of the Storeus Site and Mobile Application and/or Storeus Services at any time.


We may also impose limits on certain features or restrict your access to parts of, or the entire, Storeus Site and Mobile Application and/or Storeus Services at our sole discretion and without notice and/or liability.


We reserve the right to introduce new Services and update or withdraw any of the Services, in our sole discretion, and we will not be liable to you for exercising this discretion.


To use Storeus Website and Mobile Application you should be either at least 18 years of age or are accessing the Site/Mobile Application under the supervision of a parent or legal guardian.


We grant you a non-transferable and revocable license to use the Storeus Website and Mobile Application, under the Terms and Conditions described, for the purpose of shopping for personal items sold on the Storeus Website and Mobile Application. Commercial use or use on behalf of any third party is prohibited, except as explicitly permitted by us in advance. Any breach of these Terms and Conditions shall result in the immediate revocation of the license granted in this paragraph without notice to you.


Content provided on this site is solely for informational purposes. Product representations expressed on this Storeus Website and Mobile Application are provided by the Sellers and are not a result of Signature Technology team’s effort. Submissions or opinions expressed on this Storeus Website and Mobile Application are those of the individual posting such content and may not reflect our opinions.


Certain services and related features that may be made available on the Storeus Website and Mobile Application may require registration or subscription. Should you choose to register or subscribe for any such services or related features, you agree to provide accurate and current information about yourself and to promptly update such information if there are any changes. 


Every user of the Site is solely responsible for keeping passwords and other account identifiers safe and secure. The account owner is entirely responsible for all activities that occur under such a password or account. Furthermore, you must notify us of any unauthorized use of your password or account. 


The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.


During the registration process, you agree to receive promotional emails, short messages (SMS) and push notifications (on our Mobile Application) from the Storeus Website and Mobile Application. You can subsequently opt-out of receiving such promotional emails, messages or notifications by clicking on the link at the unsubscribe link at the bottom of any promotional email (to opt-out of the emails), sending an opt-out SMS (to opt-out of the promotional SMS) or stopping the notificatons on the Mobile Application.


The Storeus Website and Mobile Application is an e-commerce platform that allows enterprise users to offer and sell products, and individuals and enterprise entities to buy products.

Registration and User Accounts

Anything that you submit to the Storeus Site and Mobile Application and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, "Submissions") will become our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Storeus Site and Mobile Application, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.


By completing an order or signing up, you agree to receive a) emails associated with finalizing your order, which may contain relevant offers from third parties, and b) emails asking you to review Storeus.com and your purchase and c) promotional emails, SMS, and push notifications from Storeus.com. You may unsubscribe from promotional emails via a link provided in each email. If you would like us to remove your personal information from our database, unsubscribe from emails and/or SMS, please contact our Customer Care team on the contact details, stated in these Terms and Conditions.


Use of the Storeus Site is only available to persons who are of legal age for giving consent and/or “competent to contract'' pursuant to the Applicable Law. By accepting the Terms and Conditions or using or accessing the Storeus Site and Mobile Application, you irrevocably declare and undertake that you are of legal age capable of entering into binding contracts.


To access and use the Storeus Site and Mobile Application and/or Services, you shall complete the registration process by creating your account with us.


You agree to provide true, accurate, current and complete information about yourself as prompted by our registration form. You will maintain and promptly update the registration data to keep it true, accurate, current and complete and to continue with your eligibility in availing the Storeus Services. If you provide any information that is untrue, in accurate, not current or incomplete, or not in accordance with these Terms and Conditions any other terms and conditions and policies as set out in this Storeus Site and Mobile Application, we will have the right to indefinitely suspend, limit, cancel or withdraw your current and future use and access to the Storeus Site and Mobile Application and/or Storeus Services.


You are responsible for maintaining the confidentiality of, and restricting access to and use of, your account and password, and accept responsibility for all activities that occur under your account and password. You are also responsible for all activities that occur under your account and we are not responsible for any unauthorized access to your account. You agree that you will contact us immediately if you believe an unauthorized third party may be using your account or if your account information is lost or stolen or exposed to any other breach.


In no event we will be liable for any direct, indirect or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the breach of security and/or disclosure of your username and/or password.


The registration data is subject to the Privacy Policy and other terms and conditions as we may impose from time to time, you expressly allow and permit us (including our affiliates and authorized third party providers) to access, collect and retain your registration data. You also acknowledge that some or all of your registration data will be shared to authorized third party providers for the completion of your transaction in the Storeus Site and Mobile Application.


You are eligible to register as a buyer or seller and benefit from the Storeus Services if you meet the following eligibility criteria:


Buyers:

- you are above the legal age for purchasing products in your country of residence; and

- you are able to provide an address in the UAE for delivery of products.


Sellers:

- you are a legal entity duly registered in your jurisdiction;

- you have a current trade licence;

- you provide proof of authorisation for the individual who will be registering and using the Storeus Site and Mobile Application;

- you provide identification for the authorised person;

- you can provide supporting bank details; and

- you acknowledge and agree that for certain product categories, additional requirements might be applicable.


We reserve the right to decline any registration without further explanation. We reserve the right to undertake such checks as are necessary to verify your identity.

Once you have successfully completed registration, your registration shall continue for an indefinite period, subject to suspension or termination in accordance with these Terms of Use.

User Responsibilities and Obligations

The Storeus Site and Mobile Application and Storeus Services may be used only for lawful purposes and in a lawful manner. You must comply at all times with these Terms and Conditions and all other terms, conditions and policies imposed by us from time to time pertaining to the use and access of the Storeus Site and Mobile Application and Storeus Services.


For the operation, maintenance, access and use of your account in the Storeus Site and Mobile Application, you shall be responsible for the following:


- compliance of your content with these Terms and Conditions and all other terms, conditions and policies imposed by us from time to time pertaining to the use and access of the Storeus Site and Mobile Application and Storeus Services including laws, rules and regulations;


- ensuring that you will not falsify, delete, misuse, imitate, download, modify or distribute any content or listing by any Sellers or any other users of which may tantamount to an infringement, violation, or misappropriation of their rights including without limitation copyrights, trademarks, trade secret, privacy, publicity or other intellectual property or proprietary rights.


- representing and warranting that:


-- you are not impersonating any person or entity, or otherwise misrepresent yourself in association with any person or entity;

-- you agree to provide accurate information that includes without limitation mode of payment information for purchasing the Goods ordered on Storeus Site and Mobile Application;

-- you warrant that you will not use any payment information or instrument that you do not legally own or authorized to use;

-- you will not make, publish, post, upload or disseminate any derogatory, abusive, defamatory, profane, inappropriate remarks or statements about the Storeus Site and Mobile Application and/or its Storeus Services or to any of its users;

-- you will not use the Storeus Services and Storeus Site and Mobile Application for fraudulent purposes;

-- you will not collect any information about other users which include any of their personal data or information;

-- you will not use the Storeus Services to violate the privacy of others or to harass other users;

-- you will not upload, email, post, transmit or otherwise make available any material that contains software viruses, worms, Trojan-horses or any other computer code, files or programs designed to directly or indirectly interfere with, interrupt, destroy or limit the functionality or integrity of any computer software or hardware or data;

-- you will not conduct any surveys, contests or comparisons;

-- you will not upload, email, post, transmit or otherwise make available any unsolicited or unauthorized promotional materials, advertising, “junk mail”, “spam”, “pyramid schemes”, or any other authorized form of solicitation.

-- any breach of the above warranties and representations, you agree to compensate and reimburse and/or pay any fines or fees imposed by us or by any relevant authority;


When using or accessing the Services, you agree that you will not:


- post, list or upload in any manner any information which is blasphemous, defamatory, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever.


- post, list or upload content or items in inappropriate or prohibited categories or areas on our Site and Mobile Application, including:


-- content or items that may be considered culturally or religiously offensive in any way;

-- content or items which may not be considered to be in compliance with general local law, Islamic law, rules, morals, values, ethics and traditions;

-- content or items that may threaten national security;

-- content or items which may constitute or be considered to promote gambling;

-- securities, including shares, bonds, debentures, or any other financial instruments or assets of any description;

-- living or dead creatures and/or the whole or any part of any animal which has been kept or preserved by any means whether artificial or natural;

-- weapons of any description;

-- liquor, tobacco products, drugs, psychotropic substances, narcotics, intoxicants of any description and medicines;

-- items that to your knowledge are defective, fake, damaged, false or misleading or that may through normal use harm another Site user’s interest or health;

-- non-transferable vouchers; and

-- Chemicals.

-- post items you do not have a right to link to or include;

-- post counterfeit or stolen items;

-- breach or circumvent any laws, third party rights or our systems, policies or determinations of your account status;

-- use our Services if you no longer fulfil the eligibility criteria or are not able to form legally binding contracts, or are temporarily or indefinitely suspended from using our Services;

-- fail to pay for items purchased by you, unless you have a valid reason as set out in any of our policies;

-- fail to deliver items sold by you (if applicable), unless you have a valid reason as set out in any of our policies;

-- use contact information provided to you during the course of a transaction on the Site or Mobile Application to solicit additional sales offline or on another website;

-- manipulate the price of any item;

-- interfere with any other user’s listings;

-- take any action that may undermine the Site’s (Mobile Application’s) feedback and ratings systems;

-- post false, inaccurate, misleading, deceptive, defamatory or similar content;

-- transfer your account to another party without our prior written consent;

-- distribute or post spam, unsolicited or bulk electronic communications or similar;

-- distribute viruses or any other technologies that may harm our Services or the interests or property of other users;

-- infringe:

--- the copyright, trademark, patent, publicity, moral, database, and/or other intellectual property rights (collectively, "Intellectual Property Rights" ) that belong to or are licensed to us; or

--- any Intellectual Property Rights that belong to third parties;

--- harvest or otherwise collect information about users without their consent; or

--- circumvent any technical measures we use to provide the Services.

Storeus Rights

Notwithstanding the provisions of this Terms and Conditions and without prejudice to any of our rights and remedies as may be provided by law, rules, regulations and other terms, conditions and policies that may be imposed by us from time to time, we reserve our right to amend the Terms and Conditions, modify or withdraw the Storeus Website or Mobile Application without notice, refuse purchase of any or all Goods listed for sale through the Storeus Site and Mobile Application including the sole discretion to deactivate your account with us.


We may in our sole discretion use and employ the services of our affiliates and/or third-party processors or such other service providers in connection to the fulfillment of the delivery of the Good as purchased in our Storeus Services without any notice to you.


All Goods listed on the Storeus Site and Mobile Application are on an “as is'' and “as available” basis. Thus, pictures and/or images of the products are for and by reference only. In case of any variation, infringement claims or any other claims arising with such pictures or Seller’s content listing, you agree to indemnify us and hold us harmless for all such claims, damages arising from such claims. Any and all Sellers’ content and/or listing of any Goods are not endorsed or supported by us and is the sole responsibility of the respective Seller. We therefore disclaim any liabilities arising out of any such claims to this end.


At the same time, we disclaim any and/or all claims and/or liabilities arising any price revision of the Goods purchased online, irrespective whether you have earmarked or wish listed such Good.


Notwithstanding any other provisions of these Terms and Conditions and without prejudice to any of our rights and remedies, you indemnify, defend and hold us harmless for any and all loss (including to the extent that any loss is direct or indirect and/or relates to or includes any costs of investigation or professional fees or expenses) incurred or suffered 


(a) if the Goods ordered are found counterfeit or refurbished or not to be original; or 

(b) if you purchase Goods in the Storeus Site and Mobile Application in breach of any third-party agreements or proprietary rights; 

(c) on any loss of your personal information; or 

(d) any other type of fraudulent conducted is identified on your part.

Intellectual Property

All intellectual property rights, whether registered or unregistered, in the Storeus Site and Mobile Application, information content on the Storeus Site and Mobile Application and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain Storeus property. 


The entire contents of the Storeus Site and Mobile Application is also protected by copyright as a collective work under the United Arab Of Emirates copyright laws and international conventions. All rights are reserved.


We reserve our rights, title and interest to all information, content, trademark, logos, intellectual property rights on the Storeus Site and Mobile Application including the graphics, software application and platform, photos, design and software compilations source code and object code, etc. (collectively referred to us as “Intellectual Property''). You agree and confirm that no part of any Intellectual Property rights arising as a result your use and access to the Storeus Site and Mobile Application is transferred to you.


By merely registering to the Storeus Site and Mobile Application, you shall not obtain any rights under these Terms and Conditions from us or our licensors to the Intellectual Property of the Storeus Site and Mobile Application, including any related intellectual property rights.


All Intellectual Property on the Storeus Site and Mobile Application exclusively belongs either to us or to Sellers and/or any authorized third-party suppliers or partners, as the case may be. Under no circumstance that you may infringe on our Intellectual Property rights or of the user or of any other third party while using and accessing our Storeus Site and Mobile Application.


Neither you may use Intellectual Property of the Storeus Site and Mobile Application including the software licenses and applications utilized to support the Storeus Site and Mobile Application in any manner or for any purpose other than as expressly permitted by these Terms and Conditions. Neither you nor any of your permitted users may, or may attempt to:


- modify, alter, tamper with, repair, or otherwise create derivative works of any software included in the Storeus Services (except to the extent software included in the Storeus Services are provided to you under a separate license that expressly permits the creation of derivative works),


- reverse engineer, disassemble, or decompile the Storeus Services or apply any other process or procedure to derive the source code of any software included in the Storeus Services,


- access or use the Storeus Services in a way intended to avoid incurring fees or exceeding usage limits or quotas, or


- resell or sublicense the Storeus Services;


Except for the rights expressly granted under these Terms and Conditions:


- all content included on the Storeus Site and Mobile Application, including but not limited to text, graphics, logos, images, audio clips, digital downloads and software is our property or the property of our licensors. We (or our licensors, as the case may be) retain all right, title and interest in and to the Site and the Services, including, without limitation, all Intellectual Property Rights therein; and


- all rights, title and interest in and to any information, materials or other content that you provide in connection with your use of the Services, including all Intellectual Property Rights therein, will become our property.


You agree that you have no right to use any of our trademarks without our prior written consent.


All rights not expressly granted to you in these Terms and Conditions are reserved and retained by us or our licensors.

Privacy and Data Protection

Any personal information collected in relation to the use of Storeus Site and Mobile Application will be held and used in accordance with our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by applicable law and notwithstanding any other provision of these Terms and Conditions, we including our authorized third-party providers (including our and their directors, officers, agents, employees, suppliers, subcontractors or licensors) will not be liable to you whether in contract, warranty, tort (including without limitation negligence, whether active, passive or imputed, product liability strict liability or other theory), or other cause of action at law, in equity by statute or otherwise, for:


- loss of use, loss of profits, loss of revenues, loss of data, loss of goodwill, loss of business opportunities or failure to realize anticipated savings, in each case whether direct or indirect; or

- any direct, indirect, incidental, special, consequential or exemplary damages, even if a party has been advised of the possibility of such damages.


Any risk of misunderstanding, error, damage, expense or losses arising from the use and access of the Storeus Site and Mobile Application and/or Storeus Services is entirely at your own risk and we shall not be liable therefore.


Nothing in these Terms and Conditions shall limit or exclude a party’s liability:


- for fraud, including fraudulent misrepresentation, perpetrated by that party;

- for death or personal injury caused by the negligence of that party; or

- for any other liability that cannot be limited or excluded under applicable law.


In no event will we, our parent company, subsidiaries and affiliates, and our, and their directors, officers, agents, employees, suppliers, subcontractors or licensors be liable, whether based on an action or claim in contract, tort, negligence, breach of statutory duty or otherwise arising out of or in relation to these Terms and Conditions for loss of profits, loss of data or information, business interruption or other pecuniary loss or for any special, indirect, incidental or consequential damages, even if we, our affiliates, directors, officers, agents, employees, licensors, subcontractors or suppliers have been advised of the possibility of such damages.


In addition, to the extent permitted by applicable law, we (including our parent company, subsidiaries and affiliates and our, and their directors, officers, agents, employees, suppliers, subcontractors or licensors) are not liable, and you agree not to hold us responsible, for any damages or losses resulting directly or indirectly from:


- the content or other information you provide when using the Services;

- your use of or your inability to use our Services;

- pricing, shipping, format or other guidance provided by us;

- delays or disruptions in our Services;

- viruses or other malicious software obtained by accessing or linking to our Services;

- bugs, errors or inaccuracies of any kind in our Services;

- damage to your hardware device from the use of products sold on the Site or our Services;

- the content, actions or inactions of third parties using our Services;

- a suspension or other action taken by us with respect to your use of the Services;

- the duration or manner in which your listings appear in search results; or

- your need to modify practices, content or behaviour or your loss of or inability to do business as a result of changes to these Terms of Use.


If previous clauses are held to be unenforceable or inapplicable for any reason, then the total liability applicable to us, our parent company, subsidiaries and affiliates and our, and their directors, officers, agents, employee, suppliers, subcontractors or licensors, to you, whether based on an action or claim in contract, negligence or breach of statutory duty or otherwise, arising out of or in relation to these Terms and Conditions shall be limited to the lower of:


- the price the item sold for on Storeus Site and Mobile Application and its original shipping costs; and

- the amount of fees in dispute not to exceed the total fees that you paid to us in the twelve (12) months prior to the action giving rise to the liability; or AED 300.

Indemnity

You will defend, indemnify, and hold us harmless including our affiliates and licensors, and each of their respective employees, officers, directors, and representatives from and against any claims, damages, losses, liabilities, costs, expenses, compensation, reimbursement, or damages (including reasonable attorneys’ fees) arising out of or relating to any third-party claim concerning:


-  your inability to access and use the Storeus Site and Mobile Application and/or Storeus Services, including as a result of any:

 

-- termination or suspension your use of or access to the Storeus Site and Mobile Application and/or Storeus Services, 

-- our discontinuation of any or all of the Storeus Services, any unanticipated or unscheduled downtime of all or a portion of the services for any reason, including as a result of power outages, system, server or connection failure, error omission, delay in transmission, computer virus or other malicious, destructive or corrupting code, agent program or macros or other interruptions;


- breach of these Terms and Conditions including laws, rules, regulations, including other terms, conditions or any policies as we may amend and impose from time to time;


- involving alleged infringement or misappropriation of intellectual property rights of any third including the content of your listing defamatory, obscene, slanderous or violates any third-party rights (including privacy rights); or


- your use of or access to any other website or webpage linked to the Storeus Site and Mobile Application, even if we or our officers, agents, employees or other authorized third-party providers may have been advised of, or otherwise might have anticipated, the possibility of the same;


- your reliance on any data or information made available through the Storeus Site and Mobile Application and/or Storeus Services. You should not act on such data or information without first independently verifying its contents; or


- any investments, expenditures, or commitments by you in connection with your use of or access to the Storeus Site and Mobile Application and/or Storeus Services.


You agree to indemnify and hold us, our parent company, subsidiaries and affiliates and our, and their directors, officers, agents, employee, suppliers, subcontractors or licensors harmless from and against any losses, damages and expenses (including legal fees and attorney’s fees) (“Claims”) arising out of or relating to:


- any claims or demands made by any third party due to or arising out of your use of the Services;

- your violation of any of the provisions of these Terms and Conditions, including, without limitation, any of the warranties, representations and undertakings;

- your violation of any applicable laws, including, without limitation, data protection or anti-spam laws; or

- the manner in which you use our Services, including, without limitation, that the content you post, the items you list or your trademarks infringe the Intellectual Property Rights of any third party or that the content of your listings is slanderous, defamatory, obscene or violates any other rights (including privacy rights) of any third party (including other Site users).

Disclaimer

THE STOREUS SITE AND MOBILE APPLICATION AND/OR STOREUS SERVICES ARE PROVIDED “AS IS.” WE AND OUR AFFILIATES AND LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE REGARDING THE STOREUS SERVICES OR THE THIRD-PARTY CONTENT, INCLUDING ANY WARRANTY THAT THE STOREUS SERVICES OR THIRD-PARTY CONTENT WILL BE UNINTERRUPTED, ERROR FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT, INCLUDING YOUR CONTENT OR THE THIRD-PARTY CONTENT, WILL BE SECURE OR NOT OTHERWISE LOST OR DAMAGED. EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES AND LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR USAGE OF TRADE.

Suspension, Termination, Cancellation

Without prejudice to any of our rights and remedies as provided in these Terms and Conditions including laws, rules, regulations, including other terms, conditions or any policies as we may impose from time to time, we have the right to unilaterally and immediately suspend, limit, withdraw, revoke or terminate your access to our Storeus Site and Mobile Application and/or Storeus Services upon the occurrence of any of the following:


- breach of any provision of these Terms and Conditions in any manner whatsoever;

- breach of any laws, rules, regulations including other terms, conditions or any policies as we may impose from time to time for the use and access of the Storeus Site and Mobile Application and Storeus Services;

- you fail to reasonably cooperate with our investigation;

- we reasonably believe that your continued provision of our Store Services would expose you or us or our affiliates (including third-party providers) to a material security or regulatory action; or

- any other events as provided in these Terms and Conditions or any of our policies as we may amend from time to time.


You agree that we will not be liable for any claim or compensation directly or indirectly whatsoever to you or to any other person as a result of your suspension or termination of your access and use of the Storeus Site and Mobile Application.


We reserve our right to take appropriate action if you are suspected of acting fraudulently or if you file invalid and/or false claims or provide false, incomplete, or misleading information. You may be considered to be engaging in fraudulent activities if any of the following (without limitation) are met:


- you don’t reply to the payment verification mail sent by us;

- you fail to produce adequate documents during the payment details verification;

- you misuse credentials not belonging to you;

- you use invalid address, email and phone no;

- you attempt to overuse a voucher code;

- you return wrong or damaged product;

- you refuse to pay for an order;

- for Cash-on-Demand (COD) items, you use fake currency notes to make the payment;

- you abuse or harass the delivery staff;

- miscellaneous activities conducted with the sole intention to cause loss to business/revenue to noon;

- your return, undeliverable rate is very high and often the returned products are missing, fake or damaged; or

- Repeated request for monetary compensation.


If your access to Storeus Services or Storeus Site and Mobile Application is terminated for any reason, we may delete any content or other materials relating to your use of the Storeus Service (including any credits earned through loyalty programs or reward points) and we will have no liability to you or any third party for doing so. However, your transaction details may be preserved by us for purposes of tax or regulatory compliance.


For the avoidance of doubt, any amounts paid and received by us in relation to a cancelled product(s) order will be refunded.

Reporting and Notifications

In case you believe that there has been a breach and violation of the Website Terms and Conditions, please report and notify us on the details and we will conduct an investigation.


We are committed to ensuring that listed items and content on Storeus Site and Mobile Application comply with these Terms and Conditions. If you believe that a listed item or content breaches these Terms and Conditions, please notify us on the contact details and we will investigate.

Warranties, Representations and Undertakings

- You warrant, represent and undertake that:

-- you shall fully comply and will at all times continue to fully comply with all applicable laws, statutes and regulations, including, without limitation, all privacy laws and content regulation;

-- you have full power and authority to enter into these Terms and Conditions and the execution and performance of your obligations under these Terms and Conditions does not conflict with:

--- any laws, rules, regulations or governmental guidelines to which you are subject to; or

--- any other agreements to which you are a party to or to which you are otherwise bound by;

-- if you create or use an account on behalf of a business entity, you represent that you are authorised to act on behalf of such business and bind the business to these Terms and Conditions. Such account is deemed to be owned and controlled by the business entity;

-- you own or have the authority to grant the rights and licences granted to us by you under these Terms and Conditions; and

-- any content you submit as part of your use of the Storeus Services and any products that you list do not violate the rights of any third party anywhere in the world including, without limitation, any Intellectual Property Rights (whether registered or not).


- The Storeus Services are provided to you on an “as is” basis without representations, warranties or conditions of any kind. We disclaim all warranties, conditions and representations of any kind, whether express, implied or collateral, including, but not limited to, all conditions, representations or warranties of merchantability, of fitness for a particular or general purpose, of non-infringement, of compatibility or that the Storeus Services are secure or error free or will operate without interruption or will be provided in a timely or proper manner or at all.


- Furthermore, whilst we attempt to be as accurate as possible, we do not warrant that product descriptions or other content of any Storeus Service is accurate, complete, reliable, current, or error-free. Additionally, as a buyer, you agree that we are not responsible for examining or warranting the listings or content provided by us or third parties through the Storeus Services, and that you will not attempt to hold us liable for any inaccuracies or defects in any of the listings. As a seller, it is your responsibility to review the content of your listings for accuracy and you will not attempt to hold our catalogue/content providers or us responsible for inaccuracies.

Arbitration

Any disputes, controversies, or differences arising out of the implementation, interpretation, performance of these Terms and Conditions, shall be finally settled through arbitration by a single arbitrator to be appointed in accordance with the rules of the United Arab of Emirates Regional Centre for International Commercial Arbitration (CRCICA). 


The arbitrator shall be a person who is legally trained and who has experience in the information technology field and is independent of either party. The venue of the arbitration shall be the United Arab of Emirates. 


The language used in the arbitration proceedings shall be English. The award of the arbitrator shall be final and binding and may be entered in any court of competent jurisdiction and enforced in accordance with the Arbitration Law No. 27 of 1994. 


Notwithstanding the foregoing, the Storeus Site and Mobile Application reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through competent courts as mentioned above in these Terms and Conditions.

Shipping and Delivery

We reserve our right to employ and use any of our authorized third-party courier service provider or logistics partner supported by us for the delivery and shipping of your Goods ordered on the Storeus Site and Mobile Application. All deliveries shall be made on a best effort basis and we will endeavor to deliver the Goods on the estimated dates of delivery as provided in the Storeus Site and Mobile Application.


We reserve our right to delay the delivery of the Goods in case of Force Majeure which includes without limitation the following: 


- bad weather; 

- shipping/transport delays; 

- political disruptions or any other unforeseen events. 


In case of delay in the delivery of the Goods, we may, at our sole discretion, notify you of such delay.


Notwithstanding the above clause, we shall not incur liability and be held responsible in case of failure or delay in the delivery of the Goods including any damage or loss caused to the delivery of the Goods.


We may in our sole discretion withhold for investigation, refuse to process, restrict shipping destinations for, stop and/or cancel any order of Goods. We also reserve our right to cancel any order that we may, at our sole discretion, determine to be “bulk orders”.


Terms of Sale

Introduction

The Terms of Sale (part of the entire Terms and Conditions) govern the selling and/or supplying of the Goods that are listed on www.storeus.com or on any other reference (i.e. mobile application, any other website related to Storeus, etc.) (“Storeus Site and Mobile App”) to the Buyer. The owner of the Storeus Site and Mobile App is Signature Technology DMCC, a Free Zone Company duly registered with the DMCC Free Zone under business license no. DMCC-633181, with its office located at Unit No: 3707, Mazaya Business Avenue BB2, Plot No: JLTE-PH2-BB2, Jumeirah Lakes Towers, Dubai, UAE (“we,” “us,” or “our”).


Kindly read the Terms and Conditions carefully before you submit your order through/on the Storeus Site and Mobile App. By submitting an order on the Storeus Site and Mobile App, you are agreeing to be obligated by the Terms and Conditions with an immediate effect.

Orders Acceptance and Pricing

You may purchase the Goods through placing and completing the order form provided on the Storeus Site and Mobile Application. While completing the order, you will be required to insert some information requested by us and complete your payment details. Thus, you will be responsible for ensuring the accuracy of the order. Please note that when you place an order, you accept and agree to abide by the Terms and Conditions including all other policies and Applicable Laws that are made applicable for your purchase of Goods.


In order to avoid any fraud with credit or debit cards, we reserve the right to obtain validation of your payment details before providing you with the product and to verify the personal information you shared with us. This verification can take the shape of an identity, place of residence, or banking information check. The absence of an answer following such a demand will automatically cause the cancellation of the order within 2 days.


We reserve the right to proceed to direct cancellation of an order for which we suspect a risk of fraudulent use of a credit or debit card.


We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the website. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.


Each Goods in your order shall be sold by the Sellers who are registered to access the Storeus Services on the Storeus Site and Mobile Application. The actual contract of sale therefore is directly between you and the Seller. Thus, we do not have any control over, and we do not guarantee the existence, quality, safety or legality of the Goods advertised; the truth or accuracy of the Seller's content or listing and/or Seller's ability and necessary authority to sell the Goods.

Accepting Your Order

- Your order shall be deemed accepted by us upon receipt of a notification in writing (i.e. by e-mail or SMS) from us.


- It shall be understood that neither completion of submitting or completing the order submission form will constitute our acceptance of your order. Our acceptance of your order will take place only upon receipt of full payment from you.

Cancelling Your Order

- You are only entitled to cancel your order if your cancellation has been received by the Seller, immediately prior to the shipping of the Goods ordered for any reason.


- We reserve our right to cancel your order in case of the following:


-- You did not provide the information, details or documents required for the completion or delivery of the Goods you order;

-- You did not make the payment of the Goods on the due date;

-- You did not allow us to deliver the Goods to you after three (3) attempts; or

-- Delivery was unable to be made after ten (10) days from the date of order.


- We are also entitled, at our sole discretion, to withhold for investigation, refuse or reject any orders that we detect as bulk purchasing (exceed quantity limit), having questionable or erroneous information or payment details necessary to process the order and/or any other suspicious transaction.

Supplier

Each product in your order is sold either by us or by the local or international seller that is specified on the Storeus Site and Mobile Application.

Order Acceptance

Our acceptance of your order will take place when we notify you of our acceptance in writing (e.g. by email or mobile messaging). If we are unable to accept your order, we will inform you of this in writing or through a call and will not charge you for the product.

Price and Payment

The price of the Goods shall be the price stipulated / listed on the Storeus Site and Mobile Application at the time you place your order on the Storeus Site and Mobile Application.


The price shall include, in addition to the purchased Goods price, any applicable sales, tax, VAT, or any other duties or fees which you will be liable to pay to us.


In order to receive your order, you will have to make the relevant payment. All payment shall only be made to us. No other means or mode of payment shall be acceptable apart from the mode of payment available in the Storeus Site and Mobile Application. Thus, you authorize us or any of our authorized third-party payment processors to process your credit or debit card details for your order for us to collect and complete your payment.


In order to authorize a credit card, debit card or digital wallet (loyalty/rewards points) payment, we may be required to create an account for you with our third-party payment processors. By accepting the Storeus Terms of Sale this signifies your automatic acceptance of the entire Terms and Conditions of the third-party payment processors, for submission of your personal information / details. Pursuant to these Terms and Conditions, you therefore hereby authorize us to do so, and we will not be liable to you for any damage or loss you may incur as a result.


We do accept payment by the following methods – in addition of any other method that we may state on the Storeus Site and Mobile Application:


- Credit or debit card;

- Cash on delivery (COD), however, with an amount not exceeding AED 1,500. You may pay by cash on delivery subject to a fee that we (at our sole discretion) prescribe on the Storeus Site and Mobile Application for each order. 

- We reserve the right to schedule the delivery time and the ordered Goods shall be handed over to you upon your payment in cash.

- Digital wallet (reward/loyalty) points


In order to authorize credit/debit card payments, we may be required to create an account for you with our third-party payment processors, including accepting their standard terms and conditions and submitting your details to them on your behalf. You hereby authorize us to do so and we shall not be liable to you for any damage or loss you may incur as a result.

We are entitled to remove, add, modify and/or discontinue (temporarily or permanently) cards or other payment methods that we accept at any time without prior notice to you.

Delivery of Your Order

The Goods will be delivered to the address which you provided in your order.


We will endeavor to deliver the Goods to your specified address at the set date and time.


In case of any failure or delay in delivering the Goods to you at the set date, we will contact you as soon as possible with a revised estimated delivery date. In parallel, in case you were not available at your specified address at the time of delivery, we shall contact you to arrange re-delivery.


If our supply of the product is delayed by an event outside of our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay;


If you do not collect the product from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot, we will contact you for further instructions. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, we will cancel your order.


We may, at our sole discretion, withhold for investigation, refuse to process, restrict shipping destinations for, stop and/or cancel any order of Goods that breaches the provisions of this Terms and Conditions or in violation of the Applicable Law.


The costs of delivery will be as displayed on Storeus Site and Mobile Application.


The delivery date information will be displayed Storeus Site and Mobile Application.


We may, at our sole discretion, make any inquiry we deem necessary to verify your identity and/or ownership of your financial instruments by requesting that you provide us with further information or documentation, including, but not limited to requesting a form of identification and/or credit card. If we are unable to verify or authenticate any information you provide, we have the right to refuse delivery and cancel the order.


A product will be considered owned by you and your responsibility from the time we deliver the product to the delivery address and you have paid for the product.


We will issue an electronic invoice for your purchase and send such an invoice to the email address you provided to us.

Defect or Damage

We shall not provide any warranty for any of the Goods ordered on the Storeus Site and Mobile Application. The warranty on the Goods purchased shall only be provided and directly covered by the Sellers registered on the Storeus Site and Mobile Application and such warranty including its details shall be expressly stated on the respective Seller’s listing on the Storeus Site and Mobile Application.


If a Warranty is offered directly by the Seller, if applicable this information will be mentioned in the description of the product on the website, then the Seller may be contacted directly via the contact details on the website. You acknowledge that the actual contract of sale is directly between you and the Seller. Thus, we shall not be responsible for any warranty claims and you indemnify and hold us harmless against any of such claims, damages, compensation and any other claims that may arise out of such warranty obligation.

Returns, Refunds, Cancellations, Replacements

Cancellation

You may only cancel your order if your request for cancellation has been received by the Seller, immediately prior to the shipping of your order for any reason.


In case of payment by credit card or debit card and you have cancelled your order in accordance with the above provision, the authorization for payment of the Goods ordered will be voided and will not be reflected.

Return or Replacement of Goods

In case you wish to return your order whether for a refund, replacement or exchange of certain Goods, you must submit to us a return request for the delivered Goods and return such Goods within fourteen (14) days of receipt of your ordered Goods.


We are charging a fee for return/replacement of a product which is 20 (twenty) AED for Dubai, Sharjah and Ajman and 25 (twenty five) AED for the rest of the Emirates in the UAE.


Our conditions for returns are as follows:


In case of:

- You have received a wrong product;

- You have received a product that is not as described on the Site; or

- You have received a damaged product.


The product(s) can be returned, but they should be unused, in original unbroken packaging and includes all tags.


In case you changed your mind, the product(s) can be returned only in certain conditions as specified in our Returns Policy.


You agree that the Seller will acknowledge and process the refund of the listed price of the ordered Goods you wish to return upon the Seller’s acceptance of such Goods and such refund shall exclude the shipping or delivery charges you paid for. In relation to any replacement/exchange, you will have to place a new order for delivery/collection.


You accept that the refund will be issued to you as follows:


- If paid by electronic means (i.e. credit or debit card), the refund shall be processed and reflected to the same card you used for payment.


- If paid by Cash on Delivery, the refund will be processed using a voucher or loyalty points in case the amount is 500 AED or below. If the amount is greater than 500 AED, the refund will be made through bank transfer.


Subject to our Returns Policy, you accept that your refund shall only be initiated once the Seller provides you a notification that the returned Goods are received and inspected. Accordingly, you agree that you will receive the refund pursuant to the below:


- Within a period of thirty (30) days from the date the Seller sends a notification approving the refund depending on your card’s bank policies if the payment is made by credit or credit card; 


We are also unable to accept returns, replacement or exchange of Goods in the following categories:


- Underwear;

- Lingerie;

- Fragrances;

- Health & beauty (i.e. skincare, make-up & cosmetics);

- Any other Goods which are personalized to your order;

- Goods that have been used or damaged by you or are not in the same condition as you received them;

- Any consumable Goods which has been used or installed;

- Goods with tampered or missing serial numbers;

- Goods that fall under specific categories, including food, beverages, household goods, digital books, swimwear, hosiery, underwear, socks, health, contact lenses, hygiene related and personal care products and certain baby products (e.g. tethers, diapers, hygiene tissues, feeding related products) music, video and video games;

- Any other categories, items or Goods that may be mentioned or classified in the listing as cannot be returned, replaced or exchanged on the Storeus Site and Mobile Application.


In all cases, you are entitled to return, replace or exchange your received Goods only in the following cases:


- You have received a wrong order/Goods;

- There was a defect or damage in the Goods upon delivery;

- You have received the Goods materially different from the description listed and/or provided on the Storeus Site and Mobile Application;

- You did not open or use the Goods;

- You received the Goods but they do not meet the agreed specification (i.e. wrong size, color, etc.) stipulated or listed on the Storeus Site and Mobile Application;

- Any other circumstances which may be prescribed on the Storeus Site and Mobile Application from time to time.


Refund Amount

For delivered products, we will refund to you the product amount (excluding the amount paid for the original shipping fees) in full plus the cost of return:


- if the products are faulty or not as described on Storeus Site and Mobile App; or

- if your reason for return is due to an error on our side, such as an error in pricing or description, a delay in delivery etc.

- In all other circumstances, we will refund the product amount (excluding the amount paid for the original shipping fees) and you may pay the costs of return shipping.


For products not delivered, you will receive a full refund if you cancel the order;

Refund Procedure

We will issue a refund to you depending on the method you used for payment, as follows:


- if you paid by cash on delivery, we will issue a refund to as a voucher or in loyalty points; or

- if you paid by credit/debit card, you can choose to have a refund by credit/debit card or to your wallet;


If the refund amount is less than 500 AED, the refund will be made with a voucher or in reward points (loyalty points). If the amount is greater than 500 AED, the refund will be made via bank transfer.

Refund Timescale

Your refund will be initiated once your product is received back in our customer fulfillment center and inspected by our team, and the final refund will be received by you as follows:


- if the refund is to your credit/debit card, within thirty (30) days from the day on which we receive the product back in our customer fulfillment center;

- if your refund is to your loyalty points balance, you will receive the refund immediately after your product is received back in our customer fulfillment center and inspected by our team; or

- if you have cancelled your order before shipping, an automated refund will be provided back to you.

Refunds for Cash on Delivery Orders

In case of return and the payment method was cash on delivery, the customer is eligible for a cash refund within 10 days and after the 10 days if the customer was unreachable for 10 days the money will be refunded via voucher and the customer can’t request to take it in cash anymore.

Warranties, Representations and Undertakings

You warrant, guarantee and undertake the following:


- Fully comply and will always continue to fully comply with all Applicable Laws, decrees and regulations, including any content regulations, and any policy/ies that we may set from time to time;


- Have full legal capacity and authority to enter into the Terms and Conditions and make the relevant payments in accordance with the Terms and Conditions set forth herein including all other policy/ies as we may issue from time to time;


- In case you purchase the Goods on behalf of a commercial entity, you have the full and legal authority to act on behalf of such entity;


- We are not liable nor responsible for any loss, damage and/or claims arising from your use of any Goods purchased or ordered;


- Provide us with any information and/or documentation that may be requested on the Storeus Site and Mobile Application for the continuance of your use and access of the Storeus Services;


- Not to access any other person’s unless authorized to do so nor use any personal information or details obtained from any other person by the use of the Storeus Services.


- Immediately and promptly notify us if you suspected or believe that an unauthorized third party may be using your account on the Storeus Site and Mobile Application or if your account information is lost, stolen or exposed to any other breach of security;


- Provide us with the required information relating to the fulfillment of the Goods you order;


- Indemnify, defend and hold us harmless against all loss, damages, costs, expenses and any legal fees incur by you in connection with the enforcement of our right under the Terms and Conditions; and


- Indemnify, defend and hold us harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to any third-party claim concerning:


- Your use of the Storeus Services (including any activities under your account and use by your permitted users, employees and personnel);


- Your breach of or violation of Applicable Law and/or the Terms of Conditions including other terms, conditions or any policy/ies as we may impose from time to time;


- Any material, information or Goods offered in your account in the Storeus Site and Mobile Application including any claim involving alleged infringement or misappropriation of third-party rights or by the use, development, design, production, advertising or marketing; or


- A dispute between you and Seller or any other person in relation to your purchased Goods.


Storeus Services are provided "as is". We and our affiliates and licensors make no representations or warranties of any kind, whether express, implied, statutory or otherwise regarding the Storeus Services or the third-party content, including any warranty that the Storeus Services or third-party content will be uninterrupted, error free or free of harmful components, or that any content, including your content or the third-party content, will be secure or not otherwise lost or damaged. 


Except to the extent prohibited by law, we and our affiliates and licensors disclaim all warranties, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or quiet enjoyment, and any warranties arising out of any course of dealing or usage of trade.

Limitation of Liability

To the fullest extent permitted by Applicable Law and notwithstanding any other provision of this Terms and Conditions, we including our authorized third-party providers (including our and their directors, officers, agents, employees, suppliers, subcontractors or licensors) will not be liable to you whether in contract, warranty, tort (including without limitation negligence, whether active , passive or imputed, product liability strict liability or other theory), or other cause of action at law, in equity by statute or otherwise, for:


- loss of use, loss of profits, pecuniary loss, loss of data, business interruption, loss of goodwill or failure to realise anticipated savings, in each case whether direct or indirect; or


- any direct, indirect, incidental, special, consequential or exemplary damages, even if a party has been advised of the possibility of such damages.


- In addition to the foregoing, neither we nor any of our affiliates or licensors or authorized third party providers will be responsible (directly or indirectly) for any compensation, reimbursement, or damages arising in connection with:


- Any delay or failure of the delivery of your order;


- Any delay in the refund in case of cancellation of your order;


- Improper remedy of the defect of the Goods taken by you or any unauthorized service center / third party;


- Any alteration of the Goods without any prior agreement with us;


- Goods altered by you or any unauthorized service center / third party;


- Any defect in the Goods caused by your improper use;


- Any installation done by you or any unauthorized service center / third party that caused damage or defect to the ordered Goods.


- Your failure to adhere or comply with the instructions of the Goods including our policies;


- For any defect, damage, etc. in certain Goods that arises after the expiry of the warranty period mentioned above;


Notwithstanding the provisions of this Terms and Conditions, if we are found to be liable by competent court, then we and our affiliates, licensors and third-party providers' aggregate liability will be limited to the lesser of: (a) the price you paid for the Goods purchased that gave rise to the claim during the 12 months' preceding the claim; or (b) AED 300.00.


Nothing in these Terms and Conditions shall limit or exclude a party’s liability:


- for fraud, including fraudulent misrepresentation, perpetrated by that party;

- for death or personal injury caused by the negligence of that party; or

- for any other liability that cannot be limited or excluded under applicable law.


In no event will we, our parent company, subsidiaries and affiliates, and our and their directors, officers, agents, employees, suppliers, subcontractors or licensors be liable, whether based on an action or claim in contract, tort, negligence, breach of statutory duty or otherwise arising out of or in relation to these Terms and Conditions for loss of profits, loss of data or information, business interruption or other pecuniary loss or for any special, indirect, incidental or consequential damages, even if we, our affiliates, directors, officers, agents, employees, licensors, subcontractors or suppliers have been advised of the possibility of such damages.


In addition, to the extent permitted by applicable law, we (including our parent company, subsidiaries and affiliates and our and their directors, officers, agents, employee, suppliers, subcontractors or licensors) are not liable, and you agree not to hold us responsible, for any damages or losses resulting directly or indirectly from:


- supplying the products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it or making payment as required;


- damages that may result from the unauthorized repair of the product;


- loss of any saved/stored data in products that are either repaired or replaced;


- reliance by you on the content or other information provided on the Site with respect to the product you order;


- your use of or your inability to use the ordered product;


- delays or disruptions to our Site or our services;


- viruses or other malicious software obtained from the use of the ordered product;


- damage to your hardware device from the use of your ordered product; or


- your loss of or inability to do business or similar as a result of our inability to deliver the product to you.


If clauses above are held to be unenforceable or inapplicable for any reason, then the total liability (including legal fees) applicable to us, our parent company, subsidiaries and affiliates and our and their directors, officers, agents, employee, suppliers, subcontractors or licensors, to you, whether based on an action or claim in contract, negligence or breach of statutory duty or otherwise, arising out of or in relation to these Terms and Conditions shall be limited to the lesser of, a) the price the product sold for on our Site and its original and return shipping costs; or b) AED 300.


You agree to indemnify and hold us, our parent company, subsidiaries and affiliates and our and their directors, officers, agents, employee, suppliers, subcontractors or licensors harmless from and against any losses, damages and expenses (including legal fees and attorney’s fees) arising out of or relating to:


- any claims or demands made by any third party due to or arising out of your use of the Storeus Site and Mobile Application and Storeus Services;

- your violation of any of provisions of these Terms and Conditions, including, without limitation, any of the warranties, representations and undertakings; or

- your violation of any applicable laws.

Use of Voucher Codes

Storeus Site and Mobile Application accepts the use of voucher codes for orders placed online. The marketing voucher codes which are accepted on and Mobile Application entitle you at the time of ordering a product to a saving on the order being placed on and Mobile Application. 


Vouchers may also be issued to customers in exchange for advance payments made to us via transfer to our bank accounts for products intended to be purchased on the and Mobile Application. 


Our voucher codes may not be exchanged for cash. With the exception of vouchers issued in accordance with our refunds policy and vouchers issued in exchange for advance payments, we reserve the right to cancel or withdraw our voucher codes at any time.

Special Cases

The ordered items are subject to availability till they last at the time of shipping and are the sole responsibility of the seller with no liability on Storeus.com United Arab Of Emirates. Your delight is our primary aim.


In case your order is placed with high value of money you will be asked to pay a down payment whether to pay in Storeus.com`s bank account or cash in advance through our finance department at Storeus.com`s premises.


In case of return and the payment method was cash on delivery, the customer is eligible for a cash refund within 10 days and after the 10 days if the customer was unreachable the money will be refunded via voucher and the customer can’t request to take it in cash anymore


Marketing and Gift vouchers should be used once per customer.


The customer is requested to have only one account on the website.


In case of creating multiple accounts or using any voucher more than once/ per customer, Storeus.com has the right to take legal action against the customer.


Any voucher abuse will be handled by Storeus.com`s legal team and the customer account will be blacklisted and will not be able to place an order from Storeus.com again.


If the customer wants to return his item for changing mind/dislike or for no technical reason, he/she will have to pay the pick-up return fees.


Please note that postal refunds will only stay 30 days as per the new postal office rules.

Flash Sales

Flash Sale promotional discounts (Flash Sales) are short-time offers of items that may be deeply discounted and of limited availability.


Flash Sales may only be applied to one unit of each product (unless otherwise stated).


Each Flash Sale is subject to two-time restrictions. The first restriction is for the overall Flash Sale and is displayed with the specific Flash Sale. The item must be added to the Cart before this time expires. The second restriction applies after a Flash Sale item has been placed in the Cart and expires after a very limited time. Orders must be placed before the expiration of both time periods.


A Flash Sale must be redeemed by checking out by clicking the "Proceed to Checkout" button from your Shopping Cart.


A limited quantity of Flash Sales is available per item. If supplies are still available after all of the Flash Sales have been used, customers may purchase the item at its regular Storeus.com price.


Flash Sales are good only for specific products featured.


Flash Sales discounts do not apply to shipping or taxes.


If you return a product purchased using a Flash Sale, your refund will equal the amount you paid for the product, subject to applicable refund policies.
